Melanie Rubinsky was born in Brownsville, Texas.  She was admitted to the Bar in 1999.  She is also admitted to the United States District Court for the Southern, District of Texas, the Western District of Texas and the United States Court of Appeals for the Fifth Circuit.  She brings over 20 years of experience to the firm in a broad array of litigation matters with specialized experience in medical malpractice and health law.  Her additional education beyond law school in obtaining her Masters in Health Law, along with her experience in health law related matters, provides her with a distinctive advantage in handling matters for healthcare providers.  Melanie’s healthcare practice includes representation of healthcare institutions, physicians, dentists, chiropractors, nurses, physical therapists and physician assistants in matters involving medical negligence, peer review, licensure, risk management, business disputes, contractual issues, regulatory compliance, government and private reimbursement issues, federal whistleblower litigation, Stark and Anti-Kickback matters, and employment related issues including medical staffing disputes.  In addition, Melanie has extensive experience representing physicians, chiropractors, dentists, pharmacists, counselors, physical therapists and nurses before their respective licensing  Boards, including actions brought before the State Office of Administrative Hearings, establishing medical practices, drafting Buy/Sell Agreements and Non-Compete Agreements, and drafting Medical and Nursing Policies and Procedures for Hospitals and Long-Term Care facilities.  She also has experience with products liability including pharmaceutical and medical devices, as well as personal injury and premises liability cases.

In addition to representing providers, Melanie also has made presentations to various healthcare related groups regarding the defense of alleged medical malpractice cases, board complaints and regulatory compliance issues including a presentation given at the American Society for Healthcare Risk Management’s national convention.

Melanie is fluent in Spanish.
